1. Introduction

Red Alligator LLC, doing business as Offbookly ("Offbookly," "we," "our," or "us"), operates the Offbookly mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our App and related services (the "Services").

By using the Services, you consent to the data practices described in this Privacy Policy. If you do not agree, please do not use the Services.


2. Information We Collect

2.4 Voice Recordings — Special Notice

When you use the "Record for Partner" / Scene Partner feature, the App captures audio of your spoken dialogue — one clip per line — and stores it on Firebase Storage under your account. You are asked for explicit consent before your first recording.

Not biometric identification. Offbookly does not use voice recordings to create a voiceprint, to identify or authenticate any individual, or as a biometric identifier within the meaning of any biometric privacy law, including the Illinois Biometric Information Privacy Act (740 ILCS 14). Recordings are used only as playback audio in the rehearsal context you direct.

No model training. We do not use your voice recordings to train, fine-tune, or improve any speech-synthesis, voice-cloning, or other machine-learning model, and we prohibit our service providers from doing so.

Sharing with a scene partner you choose. If you share a scene, the recipient of your share code receives a downloadable copy of your recordings, the scene's dialogue, and your chosen display name — for that shared scene only. You control who receives the code. See Section 4.5.

Your control. You can delete any recording, or revoke a share, at any time in the App. See Section 6.2a for retention details.

We do NOT use your information for: selling your personal data to third parties; targeted advertising or advertising tracking; training, fine-tuning, or evaluating any artificial intelligence, machine learning, speech-synthesis, voice-cloning, or biometric-identification model (including using your voice recordings for any such purpose); or identifying or authenticating any individual from voice or audio.

4.5 Sharing with Other Users (Scene Partners)

When you create a share using the Scene Partner feature, you are instructing Offbookly to make the following available to the recipient of your share code, for that one shared scene only: your voice recordings, the scene's dialogue, and your chosen display name. The recipient must have an Offbookly account to open the share, and may download the recordings to their device for offline rehearsal.

We do not otherwise disclose your recordings to any other user. You are responsible for who you give your share code to. Recordings are delivered through a private link that contains an access token; anyone who obtains that link or your share code can access that one shared scene's recordings until you revoke the share or it expires. We therefore recommend sharing your code only with your intended scene partner.


5. Data Storage and Security

5.1 Where Your Data is Stored

Your data is stored on Google Firebase servers located in the United States (nam5). By using the Services, you consent to the transfer and storage of your data in this location.

Despite our efforts, no method of electronic storage or transmission is 100% secure. We cannot guarantee the absolute security of your data. You use the Services and upload content at your own risk.

5.4 Security Incident Notification

If we become aware of a data breach that affects your personal information, we will notify affected users and any authorities required by law without undue delay (for example, where the GDPR applies, the relevant supervisory authority within 72 hours of our becoming aware). To the extent known, our notice will describe what happened, the categories of data involved, and steps you can take to protect yourself.


6. Data Retention and Deletion

6.1 While Your Account is Active

We retain Your Content (scripts, TTS-generated audio, parsed data) and account information for as long as your account is active and the Services are being provided.

You may delete individual scripts or audio files at any time through the App. Deleted content will be removed from our active systems within a reasonable timeframe.

6.4 Speech-to-Text Transcripts

Raw microphone audio used for speech recognition is not retained by Offbookly. The resulting text transcripts are held in-memory during a rehearsal session to drive the rehearsal state machine and, where you choose to save session data, may be stored alongside your rehearsal history under your account. Transcripts are deleted along with the associated rehearsal session or upon account deletion, consistent with Section 6.2.

6.5 Anonymized Data

We may retain anonymized, aggregated data that cannot be used to identify you (e.g., total number of scripts processed, average session length) indefinitely for analytics purposes.

For California residents, the voice recordings you create are "personal information" (specifically "audio … information," Cal. Civ. Code § 1798.140(v)(1)(B)). The access, deletion, and opt-out rights described above apply to them.

We have not sold or shared the personal information of any California consumer in the preceding 12 months, nor have we disclosed it for a business purpose other than as described in Section 4.

8. Children's Privacy

The Services are not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will promptly delete such information and terminate the associated account.

Voice recording and Scene Partner sharing are available to users who are at least 13 years old. By using these features you confirm you are at least 13 (and, if you are under 18, that a parent or guardian has consented to your use of the Services). We do not use voice recordings to identify any individual, including minors — see the biometric and no-model-training protections in Section 2.4.

9. Device Permissions

9.1 Microphone

The App requests microphone access for two purposes: (1) to convert your spoken dialogue into text for rehearsal cue detection (see Sections 2.2 and 4.1), and (2) to record your lines when you use a recording feature such as "Record for Partner" (see Section 2.4). So that a rehearsal can continue hands-free, the microphone and speech-to-text may stay active while your screen is locked or the App is in the background during an active rehearsal session you have started; the App does not listen outside of a rehearsal or recording session. Audio used purely for cue detection is not retained; voice recordings are retained as described in Sections 2.4 and 6.2a. You may revoke microphone permission at any time in your device's system settings; if revoked, speech-recognition and recording features will be disabled.

9.2 Speech Recognition (iOS)

On iOS, the App additionally requests speech-recognition permission so that microphone audio can be routed to Apple's Speech framework. This permission is separate from microphone permission and can also be revoked at any time in your device settings.

9.3 Notifications

If you set an audition date in the App, the App can schedule reminder notifications for you. These reminders are scheduled and delivered locally by your device — we do not operate a push-notification server for them. The audition date and time you enter are stored with your project (and synced to your account). The App requests notification permission the first time you set an audition reminder, and you can revoke it at any time in your device settings.


10. Cookies and Tracking Technologies

The Offbookly App does not use browser cookies (as it is a native mobile application). However, we use the following technologies:

10.1 Advertising and Measurement

We promote Offbookly through ads on third-party platforms (for example, Instagram). To understand whether those ads are effective, we use Apple's privacy-preserving SKAdNetwork, which reports app installs to ad networks only in aggregate. It does not identify you, does not use your device's advertising identifier, and does not follow you across other apps or websites.

We do not display ads inside the App; we do not use advertising identifiers (IDFA, AAID) to track you; and we do not sell or share your personal information with advertisers for cross-context behavioral advertising. We do not show a tracking-permission prompt because we do not track you across apps.


11. International Data Transfers

Your data may be transferred to and processed in countries other than your country of residence, including the United States, where our servers and third-party service providers are located.

Where required by law (e.g., transfers from the EEA or UK), we rely on: Standard Contractual Clauses (SCCs) approved by the European Commission or UK Addendum, as applicable; adequacy decisions, where applicable; the data processing terms of our service providers (Google, OpenAI, Apple).


12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes through in-app notifications or by updating the "Last Updated" date at the top of this policy. For any change that expands the categories of personal information we collect, the purposes for which we use that information, or the parties with whom we share it, we will provide advance notice before the change takes effect.

Your continued use of the Services after any changes constitutes acceptance of the updated Privacy Policy.
